Published under Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, this document outlines the terms of access and use for the Zenit mobile and web platform accessible via www.zenitedu.com (the "Platform").

The Platform is operated and maintained by Jagrati Ed-Tech Private Limited ("Company"), a company incorporated under the Companies Act, 2013 with its registered office located at VK Palace, 2^nd Floor, 2^nd Cross, 10^th Main, Shankar Nagar, Mahalakshmi Layout, Bangalore, Karnataka – 560096.

These Terms of Use ("Terms") govern all users' access and interaction with the Platform and the services provided ("Services"). By engaging with the Platform or any associated Services, you acknowledge that you have read, understood, and agreed to abide by these Terms. If you do not agree to any part of these Terms, please discontinue use of the Platform and Services.

For clarity:
"You", "User", "Customer" refers to any individual accessing the Platform.
"We", "Us", "Our", "Zenit", or "Jagrati" refers to Jagrati Ed-Tech Pvt Ltd and its representatives.

We reserve the right to modify or revise these Terms at any time. Continued use of the Platform signifies acceptance of any changes.

1. Usage by Institutions
   • If you are an educational institute, organization, body corporate, or registered entity seeking to access Zenit's Services for your members or beneficiaries, you must enter into a formal partnership agreement or MoU with Zenit. Individuals under such arrangements are still bound by these Terms and our Privacy Policy.
2. Access by Minors
   • The Platform is intended for individuals aged 18 years and above. Users under 18 must submit a parental or guardian consent form ("Consent Form") prior to registration. If found otherwise, we reserve the right to revoke access. We are not liable for the consequences of unsupervised minor access.
3. Account Creation and Responsibility
   • Users may be required to share certain personal details including name, email, and contact information. You confirm that the data provided is accurate and your own. Your login credentials must be kept confidential, and all activity under your account is your responsibility.

4. Payments and Refunds
   • Zenit may levy charges for certain Services including online or offline sessions. Before engaging, the fee structure will be shared in writing.
   • All payments are non-refundable, unless specified otherwise or decided by Zenit on a case-by-case basis following a written request to support@zenitedu.com.
   • Our team will assess refund requests solely at our discretion. Our decision in such cases will be binding.

   Specific Refund Conditions:

   • Packages: Activated from date of purchase. Unused services within the validity period are not eligible for rescheduling or refunds. Session allocation is subject to expert availability.
   • Appointments:
     • Three follow-ups will be attempted by Zenit. Failure to respond within 7 days will lead to expiration of service.
     • In case of technical issues during a session, appointments may be rescheduled if the fault is validated by Zenit.
     • For no-shows in audio/video sessions, one reschedule is permitted. Missing the second appointment forfeits the session.
     • For in-person sessions, missed appointments are considered consumed.
     • Reschedule requests must be made at least 24 hours in advance.

   Payment Modes:

   • Net Banking
   • Credit/Debit Cards
   • UPI
   • Wallets (as available)
   • Zenit is not liable for failed, delayed, or unauthorized transactions via third-party gateways. Payments made through external platforms are governed by their respective terms.
   • Zenit may revise its pricing at any time without prior notice.
5. Intellectual Property and Platform Ownership
   • All content on the Platform — including text, graphics, trademarks, icons, and design elements — is owned or licensed by Zenit. Users may not reproduce, alter, or exploit any part of it without prior written consent.
   • "Zenit" and its associated visual elements are protected under applicable IP laws.
6. User Conduct
   • Users agree to use the Platform only for lawful purposes. Activities such as abuse, harassment, misrepresentation, tampering with the Platform, spamming, or uploading malicious content are strictly prohibited.
   • We reserve the right to suspend or terminate access for violations.
7. Disclaimer
   • Zenit's Services are not a substitute for clinical diagnosis or emergency medical care. The advice provided through the Platform is educational and reflective in nature. While we onboard qualified professionals, Zenit does not directly provide medical or psychiatric interventions.
   • In case of emergency or crisis (including suicidal ideation), please contact a qualified healthcare provider or a suicide prevention helpline like AASRA: 91-22-27546669.
8. Data Privacy and Security
   • Your data security is important to us. While we follow industry practices to secure information, no system is entirely immune. Users acknowledge and accept this inherent risk. Refer to our Privacy Policy for detailed data handling practices.
9. Warranty Disclaimer
   • Zenit provides the Platform "as-is" without warranties of any kind. We do not guarantee uninterrupted access, platform uptime, or accuracy of content. Use of Services is entirely at your discretion and risk.
10. Limitations and Liability
    • Zenit is not liable for third-party content, user decisions, or interactions with Experts. We are also not responsible for missed appointments, session dissatisfaction, or internet/device errors.
    • Your actions on the Platform are solely your responsibility.
11. Termination
    • We may terminate your access to the Platform at our discretion for violation of these Terms. You may also delete your account at any time. Certain provisions (e.g., indemnity, disclaimers) will survive termination.
12. Indemnity
    • You agree to indemnify Zenit and its team against any claims, losses, or liabilities arising out of your breach of these Terms or misuse of the Platform.
13. Limitation of Liability
    • Under no circumstance shall Zenit be held liable for indirect, incidental, or consequential damages arising out of your use or inability to use the Platform.
14. Dispute Resolution and Governing Law
    • All disputes will be addressed via mutual resolution. If unresolved, they shall be referred to arbitration in accordance with the Indian Arbitration and Conciliation Act, 1996. The seat of arbitration will be Bengaluru, India.
    • These Terms are governed by the laws of India, and subject to arbitration, the courts of Bengaluru shall have exclusive jurisdiction.

16. General Provisions
    • Survival: Clauses such as indemnity, limitations, and governing law survive termination.
    • Severability: If any part of the Terms is deemed unenforceable, the remaining parts remain valid.
    • No Waiver: Delay in enforcing any right does not mean the right is waived.
